Council to review ordinance requests

Rezoning issue and the vacation of a Corporate Drive storm sewer easement on agenda

Staff Reports

TROY — Troy City Council will have two ordinance agenda items to consider at its meeting at 7 p.m. Monday at City Hall.

The first ordinance is the third reading of the rezoning request for 614 S. Crawford Street from M-2 Light Industrial district to Office Commercial district. The applicant, Mike Lyons, is interested in purchasing the property and renovate the building to open a fitness center.

There were no comments for or against the rezoning issue during its public hearing on Sept. 8. The law and ordinance committee supports the rezoning request. The planning commission also approved of the request.

The second ordinance on the agenda is a request to vacate a storm sewer easement along Corporate Drive. The ordinance will have its first reading and it has an emergency designation.

According to the law and ordinance committee report, the City has no requirement that this easement be maintained. The easement must be vacated prior to Arc Abrasives purchasing the property for the construction of a new facility.

According to the report, during the site investigation process, it was determined that there is a recorded storm sewer easement for a storm water detention pond and lines that has never been needed or constructed. This easement will not be needed for the Arc Abrasives project, as the project will provide for a storm sewer retention system at another location on the site. In that Arc Abrasives cannot close on the purchase of the property until the easement is vacated, emergency legislation has been requested.
