TROY — A Troy man will serve five years in prison for inappropriate sexual contact with a female child under the age of 13 while in his care.
In previous court proceedings, David Ratcliff, 62, of Troy, entered a plea of no contest as part of a plea agreement with the state to dismiss two counts of first-degree felony rape.
Miami County Common Pleas Court Judge Jeannine Pratt ordered Ratcliff to serve the maximum sentence possible of 60 months for Ratcliff’s third-degree felony gross sexual imposition charge. The charge was part of an amended indictment which dropped three counts of felony rape for his no contest plea.
Ratcliff made no comment on his own behalf prior to sentencing.
“The court finds your conduct reprehensible,” Judge Pratt told Ratcliff prior to sentencing him to serve the maximum possible sentence.
Judge Pratt noted Ratcliff’s 1992 conviction of indecent liberties with a child in North Carolina which he served three years of a five years parole term. A pre-sentence investigation found that charge would not contribute to Ratcliff’s sentence.
The victim’s mother spoke how she had trusted Ratcliff to take care of her daughter who loved spending time with him.
“He took her love and her trust and he violated her,” the victim’s mother said. “I hope (the court) ensures that he can’t do this to any other kids.”
Miami County assistant prosecutor Paul Watkins asked the court to consider the maximum sentencing for Ratcliff’s conduct.
“The defendant preyed on the most innocent member in the community,” Watkins said.
On or around April 1 through May 30, 2015, Ratcliff inappropriately touched a female child under the age of 13 while in Ratcliff’s care.
Upon Ratcliff’s release, he must serve five years of post-release control and will register as a Tier II sex offender.
