MIAMI COUNTY — William “Bill” E. Durham, 47, of Union Township, was arraigned on two counts of rape, one count of sexual imposition and two counts of illegal use of a minor in sexually oriented materials on Wednesday.
Durham was indicted on similar charges in June 2016, but the case was dismissed on Sept. 30 and refiled and presented to the grand jury.
Durham entered a plea of not guilty.
The indictment states the charges stem from a reported sexual assault involving a minor under age 13.
Durham was released on his own recognizance due health conditions. Durham appeared in court wearing a medical mask over his face. His attorney Brandon Coate told the court Durham receives kidney dialysis nearly daily and seeks medical treatment in Indiana and Columbus.
Assistant prosecuting attorney Janna Parker requested if the court was to release Durham on his own recognizance, that he be ordered to have no contact with the minor victim. Judge Christopher Gee granted the OR bond, included a curfew with the exception of medical treatment and ordered no contact with the minor victim.
In other court news:
Carl T. Crawford, 21, of Sidney, was sentenced to serve two years of community control for fourth degree felony unlawful sexual conduct with a minor on Wednesday.
Crawford was labeled as a tier II sex offender and must register with the sheriff’s office every 180 days for the next 25 years.
Judge Christopher Gee ordered Crawford to have no contact with minors upon his release and to surrender any and all social media account information to his parole officer.
• The following persons appeared for arraignment on indictment by a Miami County grand jury:
William Ladd, 48, of Tipp City, entered a plea of not guilty on one count of aggravated possession of drug (Fentanyl). He was released on his own recognizance.
Zachariah Young, 30, of Dayton, entered a plea of not guilty to one count of second degree felony burglary and fifth degree breaking and entering. Young failed to appear for a previous court hearing. His bond was set at $10,000 and was ordered to have no contact with the victims if he was to be released.
Matthew King, 44, of Tipp City, entered a plea of not guilty to one count of aggravated possession of drugs (Fentanyl). He was released on his own recognizance.
Christopher Morgan, 32, of Mount Juliet, Tenn., entered a plea of not guilty to three counts of third degree felony possession of drugs and possession of criminal tools. He was released on his own recognizance.
Thomas Gearhart, 25, of Tipp City, entered a plea of not guilty to six counts of forgery and two counts of receiving stolen property, all felonies of the fifth degree.
Justin Johnson, 26, of Tipp City, entered a plea of not guilty to five counts of forgery and five counts of receiving stolen property, all felonies of the fifth degree.
